TERMS & CONDITIONS
Please take some time to read carefully and familiarise yourself with these terms and conditions to ensure you understand before you instruct Duguid Anderson Contractors Ltd to perform services.
1.0 CONTACT AND DEFINITIONS
1.1. We, us, our, company means Duguid Anderson Contractors Ltd. You, Your means Customer, Client.
1.2. Unless otherwise agreed in writing by an executive staff member or company director, all clients are bound by our Terms and Conditions.
1.3. These Terms and Conditions represent a contract/ Agreement between us and the Client.
1.4. Duguid Anderson Contractors Ltd reserve the right to instruct and collaborate where necessary with sub-contractors’ subject to our strict prudence, due diligence and professional judgment.
1.5. Duguid Anderson Contractors Ltd agrees to perform the work specified by the Client in a professional and timely manner. Duguid Anderson Contractors Ltd reserves the right to make alterations to any section of these Terms and Conditions without notice. Upon instruction of Duguid Anderson Contractors Ltd to perform or arrange a service, the client is agreeing to be bound by the Terms and Conditions of service prescribed by Duguid Anderson Contractors Ltd.
2.0 PRICING, QUOTATIONS AND INVOICING
2.1. Duguid Anderson Contractors Ltd reserve the right to amend the price chargeable if the property or services differ from what is described via telephone, email, website, online or if a client makes changes to their original requirements.
2.2. Duguid Anderson Contractors Ltd reserve the right to amend the price chargeable if the property is not maintained properly or the general condition of the property has been left in an unreasonable manner to which we have not been made aware beforehand.
2.3. Duguid Anderson Contractors Ltd reserve the right to take photographic or video evidence before and after any job is completed. A check-list will be completed for every work order to ensure high standards are met and evidence the legitimacy of the completion of the works. In addition, every work order is subject to an inspection upon completion.
2.4. Duguid Anderson Contractors Ltd recommends the client to check the quality of works or service (s) provided immediately upon completion.
2.5. In the unfortunate event that a client is dissatisfied with the standard of service provided, the client and/or clients representative must contact Duguid Anderson Contractors Ltd within 48 hours from the date that the service was completed. Any late notifications of a complaint surpassed the period of 48 hours, will be dealt with at the discretion of Duguid Anderson Contractors Ltd and judged on the details of the case.
2.6. In the unfortunate event of a complaint, the client will permit Duguid Anderson Contractors Ltd to arrange a re-visit to rectify any omissions. Subject to the circumstance, Duguid Anderson Contractors Ltd will not be inclined to make any reimbursement if we have not been provided the opportunity to return to the client’s property to remedy the issue.
2.7. All prices stipulated in our price lists are indicative and are only to be relied upon as a guide.
3.0 MARKETING AND ADVERTISING
3.1. You are bound by Duguid Anderson Contractors Ltd Terms of Business from the time of instruction to provide maintenance services. Duguid Anderson Contractors Ltd are able to offer all clients our full range of maintenance services and specialisms. We reserve the right, subject to your consent to advertise our brand unobtrusively as part of our bespoke offering where it is believed to be in the best interest of the client, at no additional cost to the client.
4.0 REMITTANCES
4.1. All payments for services provided to a client are payable in full within 14 days of the date specified on the invoice unless prior arrangements have been agreed upon between Duguid Anderson Contractors Ltd and the client. Any unaccounted late payments surpassed the 14-day threshold or the agreed payment terms will be subject to an additional fee equivalent to 10% of the invoiced amount.
5.0 INSURANCE
5.1. Duguid Anderson Contractors Ltd are fully and comprehensively insured. Full details of Public and Employers Liability insurance is available upon request.
6.0 LIABILITY
6.1. In the unlikely event of damaged property caused by Duguid Anderson Contractors Ltd, the company will attempt to either repair the item or credit the client in accordance with the market value of the item. Duguid Anderson Contractors Ltd take no responsibility for damaged property, unless investigated and confirmed that liability lies with Duguid Anderson Contractors Ltd.
6.2. Duguid Anderson Contractors Ltd will not be liable for any omissions caused to any services undertaken as a result of a third party.
7.0 TERMINATION OF CONTRACTS/ AGREEMENTS
7.1. Termination of an agreement can be effected by either party giving 28 days’ written notice, subject to the agreed minimum period, which is set at 12 weeks. The agreement will continue after the minimum period unless or until terminated by either party.
If you wish to terminate the contract immediately without abiding with the minimum period of 12 weeks, you will be permitted to terminate the agreement subject to providing written notice, however you will be liable to pay a surcharge equivalent to a minimum period of 4 weeks.
8.0 PROVISION OF EQUIPMENT AND PRODUCTS
8.1. Duguid Anderson Contractors Ltd will supply all necessary materials and equipment to carry out the works instructed upon unless agreed otherwise with the client. Please note this may be subject to a surcharge and subject to the discretion of Duguid Anderson Contractors Ltd.
Duguid Anderson Contractors Ltd will ensure all materials and equipment are adequately serviced, maintained, clean and fit for purpose.
9.0 WORK ORDERS
9.1. Prior to Duguid Anderson Contractors Ltd undertaking works, clear instructions and details should be provided in the form of a work order or suitable alternative. Duguid Anderson Contractors Ltd must be notified before the appointment of our services of any existing damages. Any damage upon arrival of a site will be reported prior to the commencement of our services. Duguid Anderson Contractors Ltd will always endeavour to provide the best possible service in accordance with industry standards and methods. Duguid Anderson Contractors will not be responsible for any defects to a property which cannot be resolved outside of the scope of our instructions or after we have applied normal practice methods.
9.2. Duguid Anderson Contractors Ltd will be explicit about what is included within any scope of works and the associated fees chargeable. Each work order will be judged on the works or services required and can be subject to change. If a client wishes to make special requests, such wishes should be made apparent at the point of booking. Please note each special request could be subject to a surcharge.
9.3 Duguid Anderson Contractors Ltd reserves the right to request for photographs, videos or reasonable supplementary information to be provided with any work order. Any sensitive information supplied to Duguid Anderson Contractors Ltd will be dealt with in accordance with the Data Protection Act 2018.
- CALL OUT CHARGES
Duguid Anderson Contractors Ltd reserves the right to apply a ‘call out charge’ for all maintenance works. The ‘call out charge’ will range from £75 to £150 depending on the call out. The ‘call out charge’ is payable, in addition to, the cost of carrying out any maintenance works.
- CANCELLATION CHARGES
Once you have booked an appointment with Duguid Anderson Contractors Ltd it means that we have reserved time in our schedule exclusively for you. If you cancel your appointment less than 24 hours before it is scheduled to take place, you will be subject to a cancellation charge of £75.
This includes appointments where we are unable to access the property, are turned away or refused entry, no-shows, an unsafe environment restricts us from conducting works or there is no access to utilities where utilities are required to perform works.
To avoid a cancellation fee, please provide cancellation notice at least 24 hours prior to your appointment. You can cancel or reschedule an appointment by emailing us at info@duguidanderson.co.uk .
- TERMS OF USE
12.1 These terms and conditions and all contracts awarded between the us and the
client shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.
12.2 Acceptance of our goods, services or quotation is an automatic acceptance of these terms and conditions.
